Thank you for choosing our services for your customized gift design needs. To ensure a clear and mutually beneficial relationship, please review the following terms and conditions:
Intellectual Property Rights
Ownership: All designs, concepts, and materials created by Bare & Brown, a brand by Trussel General Trading LLC remain our exclusive property. Usage: Clients are granted a limited license to use the customized designs solely for personal, internal purposes or showing it to further clients only for taking bulk orders. Commercial reproduction or distribution without explicit permission is prohibited.
Design Approval Process
Revisions: Our service includes 2 x minor design revisions. Additional revisions may incur extra charges.
Final Approval: Production will commence only after receiving written approval from the client along with 100% Payment Receipt.
Payment Terms
Deposits for Sample Making: A non-refundable deposit of 100% is required before initiating the design/sample making process.
Deposits for Actual Order: A non-refundable deposit of 100% is required before initiating the order.
Cancellation and Refund Policy
Design Phase: Cancellations during the design phase may result in forfeiture of the deposit.
Production Phase: Cancellations after production has begun are non-refundable.
Delivery and Shipping
The final customized product may or may not vary by 15 to 20% depending on the material/stock situation. The client will be informed prior on this.
Timelines: From sample approval to actual delivery, production time varies from 10 to 30 working days. Estimated delivery dates are provided but may vary due to unforeseen circumstances.
Shipping Costs: Clients are responsible for shipping fees for the sample + the actual order, unless otherwise specified. Additional charges apply for expedited service.
Fragility
Due to fragile nature of the gifts, breakage or material gone bad (for e.g chocolate being melted) during delivery will not be the responsibility of Bare & Brown, as the delivery is handled by a third party.
Liability and Indemnification
Product Use: We are not liable for any misuse of the customized gifts by the client or end recipients.
Confidentiality
Non-Disclosure: Both parties agree to keep all proprietary information confidential.
Governing Law and Dispute Resolution
Jurisdiction: This agreement is governed by the laws of UAE.
Arbitration: Any disputes will be resolved through binding arbitration.
Customization Limitations
Feasibility: We reserve the right to decline customization requests that are technically unfeasible or conflict with our brand’s standards.
Client Responsibilities
Accurate Information: Clients are responsible for providing accurate specifications and information.
